Privacy Policy

Prococious Technology Inc. (referred to as "we", "us" or "our") collects and stores personal information in compliance with the Personal Information Protection and Electronic Documents Act of Canada ("PIPEDA"). This Privacy Policy statement informs you of our pledge of confidentiality and commitment to the privacy principles described in PIPEDA. This Privacy Policy also includes our personal information collection and usage practices and policies, no matter how the information is collected, used, or disclosed.

In this Privacy Policy, personal information, personal health information, and personal contact information have the meanings ascribed to them in PIPEDA and "you" and "your" refer only to individuals. This Privacy Policy does not apply in any circumstances where PIPEDA does not apply.

Accountability

We have established rules and guidelines within our organization in compliance with this Privacy Policy, under the principles outlined in PIPEDA, and have designated at least one person to be accountable for compliance. Our designated Privacy Office is responsible for the overall compliance to the provisions of this Privacy Policy, whose contact information is as follows:

We will gladly make copies of this Privacy Policy available to the general public via fax, e-mail, at www.prococious.com and www.cleardent.com, and regular mail. We require self-stamped and addressed envelope for regular mail.

Our privacy officer will also make the specifics of our rules and guidelines practiced within our organization in compliance to this Privacy Policy and PIPEDA available to you upon requests. However, we do have a systematic process that governs us on how we respond to the request.

Identifying Purposes

We will identify the purposes for which we intend to use personal information, in writing and verbally or over the telephone or electronically. Our Privacy Officer will explain these purposes to you. In some cases, the purposes for collecting personal information are obvious and thus not explained, but you will always be able to request appropriate explanation for the purposes.

In addition to appropriate explanation at the time of information collection, we will also identify the following general purposes and uses of personal information, personal health information, and personal contact information collected:

  • Deliver products and services to our customers
  • Deliver newsletters, updates, and all other written communications to our customers and prospective customers.
  • Deliver promotional materials to past, current, and prospective customers.
  • Maintain business relationship with our business partners who also have active and mutual relationship with our customers.

We do not sell or lease out our customer list, nor personal information that we have collected. The information will only be transferred to a third party in whole as an asset of an entire business unit within our organization when our organization have sold that entire business unit to a third party. In such event, the ownership of the personal information collected will no longer remain in our organization.

Consent

We will make a reasonable effort to ensure you understand and know how your personal information will be used. We will obtain consent from you before or when we collect or use your personal information. Occasionally, we may identify a new purpose of information usage, and we will seek your consent to use and disclose personal information for that purpose prior to commencing the usage.

The Consent will be obtained implied or expressed. Implied Consent is obtain through action or inaction such as accepting a new products or services offered by us (action), with a statement displayed to you in a reasonable and legible form prior to commencing the usage, or when you fail to respond within a reasonable time frame to our specific request (inaction), such as removing your name from a list.

Expressed Consent is the preferred form and may be given in writing or verbally over the phone or electronically.

We may collect, use or disclose personal information without your knowledge or consent in exceptional circumstances where such collection, use or disclosure is permitted or as required by law. In addition, we may also collect, use, or disclose personal information without your knowledge or consent when:

  • We are to provide products or service to a person acting as your agent in our reasonable judgement.
  • We are to provide our legal representative the information for legal matters, such as investigation into a breach or contravention of a law.
  • We need the information to protect and defend us and our customers’ rights and properties.
  • We need the information for debt collection or compliance to a law authority.
  • We are to provide information to a third party that has active and mutual relationship with you and such information is needed to complete business related functions to you such as product and service fulfillment and data processing or conversion.
  • Where PIPEDA permits disclosure without your consent.

Lastly, when we obtain personal information from another organization that is also governed by PIPEDA, we will assume that proper Consent have been obtained from you by that organization before we have received the information.

When you refuse to Consent, subject to prior contractual agreement, we may not be able to offer or continue products and services that may be of value to you.

Non-personal information derived from personal information will also be collected and used by us. However, since non-personal information cannot be tracked back to you by reasonable efforts, usage of the non-personal information will not be governed by this Privacy Policy and Consent will be unnecessary.

Pledge of Confidentiality

All of our employees and contractors have pledged to maintain confidentiality of all personal information.

Limiting Collection

We will limit the collection of personal information to that which is necessary for the purposes we have identified to you, using means that are fair and lawful.

We will collect your personal information primarily from you. However, we may also collect it from external sources such as public or commercial directories and listings.

Limiting Use, Disclosure, and Retention

We will use or disclose personal information only for the purposes it was collected, unless we have obtained further Consent to use or disclose it, or we are permitted or required by law.

Under certain circumstances, we have a legal duty or right to disclose personal information without the individual's knowledge or consent.

We retain personal information only as long as it is required given the purpose it was collected.

Accuracy

We will keep your personal information as accurate, complete and up-to-date as necessary for the purposes for which it was collected and used. We will update the information when necessary. We also rely on you for keeping certain personal information accurate, complete, and current.

Safeguards

We will take all appropriate and reasonable measures to assure the security of all personal information received or stored. Our security policy may be different depending on the sensitivity and storage medium of the information. All electronic data is stored on secure servers and access is only limited to network administrators and authorized personnel on a need-to-know basis. Paper files are kept in controlled facilities and access is restricted.

As a condition of employment, personnel in our organization are required to abide by our rules and guidelines and are prohibited from disclosing any personal information except when it is necessary to carry on assigned duties.

In the event that personal information must be provided to a third party, we require the third party to safeguard the information that is consistent with our Privacy Policy and that the third party must be one or all of the following:

  • A required party that will assist us in providing the products and services that we are offering you.
  • A party that has active and mutual business relationship with you, and the information we provide will help them and/or ourselves to provide the products and services you need or we offer.

Further, we will only provide the minimum information needed to the third party.

Customer Database

We receive from our customer’s personal information contained in our customer’s databases for our duty and responsibility as a provider of information technology, and having access to our customer’s database is crucial for us to provide quality services such as troubleshooting, technical support, practice management consultation, and any other business functions that relates directly or indirectly to the use of our productions and services.

With respect to this special situation, this provision is applied to the customer’s database and all other provisions in this Privacy Policy do not apply to the customer database.

Provision

We make no use of Customer Database except to perform the services for the Customer described above.

The Customer is responsible to obtain the appropriate Consent for the collection, use and disclosure of personal information contained in the Customer Database and to ensure that its Customer Database is maintained in compliance with PIPEDA.

The Customer Database remains the sole property of the Customer. Pursuant to our licensing and service agreement with the Customer, we will keep the confidentiality of the Customer Database and make no use of the Customer Database other than providing technical services outlined in the license and service agreement or per customer’s request. We will treat the Customer Database the same way we treat our own confidential information and will provide all reasonable effort to safeguard the information from being disclosed inadvertently. The Customer Database, in whole or in part, will only be disclosed when permitted or required by law.

Our employees and contractors will also have access to the Customer Database on a need-to-know basis, and that implies that they have agreed to maintain the confidentiality in a manner which is consistent with this Privacy Policy.

Individual Access

We will inform you of the existence, use, and disclosure of your personal information upon request and with all applicable charges paid. You are entitled to challenge the accuracy and completeness and have it amended as appropriate should you believe the information is incorrect or inaccurate.

However, we may not be able to provide information about you if it would

  • Reveal personal information about a third party who we do not have Consent,
  • Subject to legal privilege or legal restrictions,
  • Contain other confidential information which would be revealed,
  • Have information that was generated in the course of a formal dispute resolution process,
  • Relate to an investigation of a breach or contravention of laws,
  • Be prohibitively costly to provide

Challenging Compliance

You may challenge our compliance as stated in this Privacy Policy, and our Privacy Officer will investigate and respond to the challenge. If the challenge is justified, we will take appropriate measures, including changing our rules and guidelines, to ensure that other individuals will not be affected.

Amendments

We may add, modify or remove portions of this Privacy Policy at any time and such change will become effective upon making our updated Policy available to the public.
